Welcome to UnNestGA.com and unnestga.blogspot.com, together referred to as the “Website.” The Website is operated by Solomon Greene, Solomon Greene Real Estate, a Georgia real estate business affiliated with Drake Realty, Inc. (“Solomon Greene,” “we,” “us,” or “our”).
By accessing or using the Website, you agree to these Terms of Use. If you do not agree, please do not use the Website.
1. Informational purposes only
The Website provides general information about real estate, homes, neighborhoods, market conditions, financing resources, home values, products, and related topics. Website content is not legal, tax, financial, lending, inspection, appraisal, insurance, or other professional advice.
Information on the Website does not create an agency relationship, brokerage relationship, fiduciary duty, representation, warranty, client relationship, or contract for brokerage services. A brokerage or agency relationship exists only if established in a separate written agreement signed by the appropriate parties.
You should consult qualified legal, tax, lending, insurance, inspection, appraisal, or other professionals before making decisions based on Website information.
2. Real estate listings and Georgia MLS Content
The Website may display, link to, or embed real estate listings, photographs, descriptions, prices, property details, maps, valuation information, and other data supplied by Georgia MLS or other third parties (“MLS Content”).
MLS Content is provided for consumers’ personal, noncommercial use to identify properties they may be interested in buying, selling, or evaluating. It may be incomplete, delayed, changed, withdrawn, or inaccurate. Information is deemed reliable but is not guaranteed.
Solomon Greene Real Estate does not independently create, verify, maintain, or guarantee all MLS Content. Georgia MLS, its licensors, listing brokers, agents, vendors, or other third parties may supply, host, transmit, format, or control the content. Solomon Greene Real Estate does not control the accessibility, availability, functionality, coding, images, captions, alternative text, keyboard operation, screen-reader compatibility, or other technical characteristics of an embedded MLS interface or listing.
To the extent permitted by applicable law, Solomon Greene Real Estate is not responsible for an accessibility barrier, outage, error, omission, or other defect originating in MLS Content or an embedded third-party service. This provision does not limit any obligation that cannot lawfully be limited and does not restrict a person from asserting rights under applicable disability, civil-rights, consumer-protection, or other laws.

A link or embedded feature does not necessarily mean that Solomon Greene Real Estate owns, operates, supervises, or controls the third party.
Where practical, we will try to provide a non-embedded or alternative method for accessing important information. You should contact the third party directly concerning content or functionality it controls.
5. Home value and automated valuation information
Any estimated home value, market estimate, neighborhood report, or automated valuation is informational only. It is not an appraisal, inspection, comparative market analysis, listing recommendation, offer, or guarantee of a sales price.
An appropriate listing price should be determined after considering the property’s condition, location, market conditions, comparable sales, and other relevant information.
6. Gift shop and merchandise
The Website may offer apparel, coffee mugs, household products, and other merchandise (“Products”). Product descriptions, colors, images, availability, and prices may change without notice. We do not guarantee that colors displayed on your device accurately represent the Products.
Orders are subject to acceptance and availability. We may refuse, cancel, or limit an order, including when an item is unavailable, incorrectly priced, suspected to be fraudulent, or affected by a technical error. If we cancel an order after payment, we will refund the amount charged for the canceled item.
The checkout page, order confirmation, and any separate return, refund, shipping, or exchange policy are incorporated into these Terms. If there is a conflict, the more specific merchandise policy controls for that transaction.
The applicable payment provider processes payments. We do not receive or store complete payment-card numbers through the Website unless expressly stated in the checkout process.
7. User Communications
If you submit a message, review, suggestion, photograph, or other material, you represent that you have the right to submit it and that it does not violate another person’s rights or any law.
You grant Solomon Greene Real Estate a nonexclusive, royalty-free license to use, reproduce, display, and distribute submitted material as reasonably necessary to operate, promote, secure, or improve the Website and our services. We may remove or decline to publish submitted material, but we are not required to monitor all submissions.
Do not send confidential information, passwords, financial-account information, Social Security numbers, medical information, or other sensitive information through an ordinary Website form or email.
8. Intellectual Property
The Website’s original text, logos, design, graphics, and other materials belong to Solomon Greene Real Estate or its licensors and are protected by applicable intellectual-property laws. You may view and print reasonable copies for personal, noncommercial use. MLS Content remains subject to the rights and restrictions of Georgia MLS, listing brokers, agents, photographers, and other rights holders.
9. Disclaimers
To the fullest extent permitted by law, the Website, its content, and its services are provided “as is” and “as available.” We disclaim warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted availability, error-free operation, and freedom from harmful code.
We do not guarantee that the Website, MLS Content, Third-Party Services, Products, or communications will always be available, accurate, secure, current, accessible, or free from errors.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, or rights and remedies that cannot be waived.
10. Limitation of liability
To the fullest extent permitted by law, Solomon Greene Real Estate and its owners, employees, agents, affiliates, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost opportunities, or business interruption arising from or related to the Website, MLS Content, Third-Party Services, Products, or your use of or inability to use them.
To the fullest extent permitted by law, the total aggregate liability for claims arising from the Website or Products will not exceed the greater of the amount you paid us for the specific Product or service giving rise to the claim during the six months before the event, or $100.
These limitations do not apply to liability that cannot legally be limited.
11. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Solomon Greene Real Estate and its owners, employees, agents, affiliates, contractors, licensors, and service providers from claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from your unlawful use of the Website, your submitted content, your violation of these Terms, or your violation of another person’s rights.
This provision does not require you to indemnify us for our own fraud, intentional misconduct, or liability that cannot legally be shifted.
12. Dispute Resolution
Georgia law governs these Terms, without regard to conflict-of-law principles.
Before filing a lawsuit or arbitration concerning the Website or Products, the parties will attempt in good faith to resolve the dispute by written notice. Send notice to sgreene@unnestga.com and Solomon Greene Real Estate, 2700 Braselton Hwy, Suite 10-409, Dacula, GA 30019. The notice must describe the issue and requested resolution. The parties will have 30 days to attempt resolution, unless a shorter period is required by law or necessary to seek emergency relief.
Any arbitration provision should be reviewed by a Georgia attorney before use, particularly for consumer transactions. If arbitration is retained, it should clearly state the provider, fee allocation, location or remote procedure, small-claims option, individual-claim requirement, and legally required exceptions. Do not use a blanket waiver of ADA claims or other nonwaivable statutory rights.
Any court proceeding permitted under these Terms must be brought in a state or federal court located in Gwinnett County, Georgia, unless applicable law requires another forum. Each party consents to that jurisdiction and venue.
13. General Provisions
If any provision is unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain effective. No waiver is effective unless in writing. These Terms, together with incorporated policies and written order terms, are the entire agreement concerning Website use.
We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively. The Terms in effect when an order is placed govern that order unless applicable law requires otherwise.
